Separation and divorce: how it works

Separating is hard. Here is how we guide you from the first conversation to a finalised divorce.

  1. 1Step 1

    Confidential first meeting

We listen to your situation, explain your rights and options, and help you focus on what needs to happen first.

  2. 2Step 2

    Interim arrangements

We help you sort out immediate issues, such as where the children will live, who stays in the home, and how bills are paid.

  3. 3Step 3

    Confirming separation

You must be separated for at least 12 months before applying for divorce. If you separated under one roof, we prepare the extra evidence needed.

  4. 4Step 4

    Divorce application

We prepare and file your sole or joint application with the Federal Circuit and Family Court of Australia. If you were married for less than two years, we explain the counselling requirement.

  5. 5Step 5

    Service and hearing

For a sole application, we arrange service on your former spouse. We tell you whether you need to attend the hearing, which in many cases you don't.

  6. 6Step 6

    Divorce order

The divorce usually takes effect one month and one day after the order is made. We remind you of the 12-month time limit for property claims.

Property settlement: how it works

We help you reach a fair division of property, debts and superannuation, by agreement wherever possible.

  1. 1Step 1

    Initial advice

We explain how property settlements work, the likely range of outcomes for your situation, and the time limits that apply.

  2. 2Step 2

    Financial disclosure

Both parties must give full and frank disclosure. We help you gather bank statements, tax returns, superannuation details and other documents.

  3. 3Step 3

    Identifying the asset pool

We list and value everything owned and owed, including the home, investments, businesses, trusts and superannuation.

  4. 4Step 4

    Assessing your entitlement

We look at each person's financial and non-financial contributions and future needs, and advise on what would be just and equitable.

  5. 5Step 5

    Negotiation and mediation

We negotiate with your former partner or their lawyer, and support you through mediation, aiming for an agreement without court.

  6. 6Step 6

    Making it binding

We formalise the agreement with consent orders or a financial agreement, then carry out property transfers and superannuation splits. If agreement isn't possible, we advise on court proceedings.

Parenting arrangements: how it works

Every decision about children starts with their best interests. Here is how we help parents reach workable arrangements.

  1. 1Step 1

    Initial consultation

We listen to your concerns, explain how the law decides parenting matters, and talk through arrangements that could work for your family.

  2. 2Step 2

    Interim arrangements and safety

We help put short-term arrangements in place, and take urgent steps if there are safety concerns for you or the children.

  3. 3Step 3

    Family dispute resolution

Most parents must try mediation before going to court, unless an exception applies, such as family violence or urgency. We prepare you for it and support you through it.

  4. 4Step 4

    Parenting plan or consent orders

If you reach agreement, we document it as a parenting plan or as consent orders that are legally binding.

  5. 5Step 5

    Court if needed

If agreement isn't possible, we prepare your court application or response, and brief an experienced barrister where needed.

  6. 6Step 6

    Reviewing arrangements

Children's needs change as they grow. We help you update arrangements or change existing orders when circumstances change.

Wills and estate planning: how it works

A well-prepared will and power of attorney give you and your family peace of mind. Here is how we prepare them with you.

  1. 1Step 1

    Initial meeting

We talk about your family, your assets and your wishes, including who you want to look after your estate and any children.

  2. 2Step 2

    Reviewing your assets

We look at assets that may not pass under your will, such as jointly owned property, superannuation, and company or trust assets.

  3. 3Step 3

    Drafting your documents

We prepare your will and, if needed, an enduring power of attorney, in clear language that reflects your wishes.

  4. 4Step 4

    Review and changes

We go through the drafts with you, answer your questions and make any changes before anything is signed.

  5. 5Step 5

    Signing correctly

We supervise signing so your documents meet Queensland's witnessing requirements and are valid.

  6. 6Step 6

    Safe keeping and updates

We can hold your original documents in safe custody. We recommend reviewing them after marriage, separation, divorce, the birth of a child, or a major change in assets.
